The other day I got a call from a friend. After chit chatting a bit about his insurance needs, he said, we do not have many assets. Do we really need to get a will? Can you help me?
Without batting an eye, I replied that he absolutely needed one. Since I am not an attorney, I told him that I could not write one but I strongly recommended he talked with a qualified attorney whose specialty is family and estate planning.
From my perspective, a will simplifies things for the living loved ones. Also it allows a person to speak their wishes from the grave. It sets the record straight and ensures that children go to the appropriate guardian.
Did you know that depending on the laws of your state, the state would determine where your children end up if both of you dies. What do you want to happen with your children? Do you want them to stay together? Go to your in laws? Or to that relative that you cannot stand?
Getting a will takes work; it means that I have to give it some thought. You probably will get in an argument with your spouse. You will have a hard time deciding on who is going to be the guardian for your children. It takes a little planning but it will give you peace of mind, I promise! An attorney should be able to help and help you out with options and ideas.
A disaster can happen any time. I live in Atlanta, drive 25 miles one way to the office. I drive at least 65 miles per hour (yeah right!) and see at least some 500 cars on my way. There are other people out there that are crazier than me.
The other day, the person in front of me was reading the paper. The lady to my right was putting on mascara , the man to my right was reading a book, the couple behind me were smooching , it startled me so much I dropped my biscuit. .
In all seriousness, talk to an attorney . If you do not have one, ask your friends. Just make sure that he or she has the experience in writing a will. Depending on the complexity of the will, it should be in the $ 1000 to $ 2000 range.
